The Regular Meeting of the Bear Lake Village Council was called to order by President Jeff Bair at 7:30 p.m. at the Bear Lake Village Hall.

Present: President: Jeff Bair Council: Ron Ronning, Don Hyrns, Jackie Johnson, Carver Edwards, Janene Gee, Peggy Bass, Treasurer: Alice Howe, Clerk: Melanie Ware and Staff: Donna Ronning.

Absent: Howard Higley

Guests: David Bluhm, Flies and Vandenbrink

Motion by Ronning seconded by Edwards to pay Fleis and Vandenbrink Engineering $9,500.00 to complete the Preliminary Engineering Report, Environmental Report, and complete and submit the USDA-RD RUS funding application. Professional Service Agreement signed. Motion carried.

Discussion was held regarding the water project. [see Report here]

Motion by Bass seconded by Gee approving the 2015 Village of Bear Lake Regular meeting dates.
January 21, 2015, February 18, 2015, March 18, 2015, April 15, 2015, May 20, 2015, June 17, 2015, July 15, 2015, August 19, 2015, September 16, 2015, October 21, 2015, November 18, 2015, and December 16, 2015. Motion carried.

Motion by Ronning seconded by Johnson to hire Mead & Hunt Facility Operations, Inc. to perform the Cross Connection Control Program. Pending approval from Randy Hyrns (Village Attorney). Motion carried.

Discussion: Check water ordinance regarding contracting out our Cross Connection Control Program and also check with the Village Attorney.

Equipment: None

Museum: Progress is moving forward. If you would like to become a founder you must donate $100.00 now through the end of December 2014. The Architect is working on the plans and should have them done soon.

Planning Commission: The Master Plan for the Village of Bear Lake is DONE! There are 2 copies available for viewing at the Village Hall. Copies must stay at the Hall.

Old Business: Check with the Village attorney regarding hiring a Deputy Treasurer and Deputy Clerk.

Public Comment:

Corky Best, suggests that minutes be completed using council members last names.

Dendra Best informed the council that she believes she is the last person hired as deputy clerk. Then she informed the council that Public comment should be mentioned in the minutes. Even if there are none it should be listed as none.

Discussions Held On: 

-Correspondence from Jason Evans was read. He wrote a poem and has donated it to The Bear Lake Area Museum to be put on display. The Museum Committee will decide when it will be displayed. (Corrected)

-Jeff Bair, Jackie Johnson, Carver Edwards, Peggy Bass, and Janene Gee took their Oaths of Office.

-Bear Lake Township has established a resolution establishing policy for the Freedom of Information Act. The Board should consider a similar resolution.

– Michigan Association of Municipal Clerks have open enrollment, should consider the Clerk becoming a member. – A motion was made and carried for Melanie Ware to become a member.

-Park- Donna to purchase totes to organize the park business.

-Reminder regarding the tree in the park that needs to be removed. It should be removed by a licensed tree remover. It will be best to wait for the lake to freeze so that it can be dropped onto the ice.

Manistee County is responsible for plowing Russell Street.

-Repairs are needed to the water system. Mike Engels would like to meet with each board member to go over the findings from the water reliability study that he performed. This can be done in small groups of 2 at the Methodist Church. The study will help determine the exact method of calculating water bills, how to set rates, and building a reserve.

-Fleis & Vandenbrink will be attending the December meeting.

-Ask Gary McBride if he would like the opportunity to submit a bid for our Cross Connection program or if he had a subcontractor that would be interested.

-The heat is on in the Museum. It was recommended that we not split the gas meter for heat. But rather split the bill accordingly.

-The Museum Society met with Kendra Thompson, an architect, she is willing to donate her time and drawings to help. The bathroom in the museum does need to be brought up to ADA standards. The museum will also need drinking fountains and it will need to be checked for asbestos. More updates that are needed include: The west north wall of the meeting room to be removed, the first bathroom to be in the Village Hall to be handicapped accessible, and the back door needs to be the main entrance. (corrected)

-The Planning Commission meets in December.

-The Village is hiring a part-time Deputy Clerk/Treasurer. Post request for resumes on the Website and bulletin outside the Hall.

-The colors and the layout of the website should be changed.

Discussions Held On:
-Reimbursements to the General Fund for September 2014; From the Major Street $86.68, Minor Street $0, Park Fund $1,107.00, Water Fund $801.00. Total to transfer to General Fund =$1,994.68
-Ask Alice (treasurer) about the $2,000 that has not been deducted from the Savings Account.
-Send a note in response to Rick Farfsing’s response of help for grant writing. This was a generous offer.
-Jeff Harthun called and talked to the building inspector regarding the Museum and the occupancy permit. An Architect is looking into the historical aspect of the building.
-Charter Communication is to be put on “vacation mode” at the Hopkins Park until April 15, 2015.
-There is an ash tree in the park next to site 24 that needs to be taken down.
-Fleis and Vandenbrink to attend the December 2014 meeting to present the recommendations for upgrading the water system.
-Friday October 24, 2014 at 10:00a.m. at the Bear Lake Methodist Church – A study session to with Michigan Rural Water to help determine our course of action. Meeting to be posted to the website.
-In the future there will be public meetings held to inform the community.
-USDA Funds become available this month (October).
– Roof above the bathroom in the museum is leaking again. This should be repaired.
-Stedman did an evaluation of the furnace for the hall and museum.
-Congratulations to Glen Moore for his many years of service to the Village of Bear Lake.

Discussions Held On: 

-Report Fund reimbursements monthly. From Park,$6,480.00 Water, $4,941.00 Major St.,$3,170.33 and Minor St.,$2,073.45 to General.

-The Park host is set for 2015. The hosts will be there June and August and the Roninng’s will fill in for the month of July.

-The Charter bill for the park and the Village Hall will be paid as a standard bill. The Park Charter bill will go on hold beginning mid-October.

-New Chlorinators are being installed on September 18, 2014.

-The water system evaluation was completed. The Village of Bear Lake is in need of adopting a long term 20 year plan, which will need to be updated every three years. The current water bills have been at $60.00 per quarter since 2009. Businesses that use more water should also be evaluated. The Village needs to prepare for repair and replacement costs.

-There are computer programs that will benefit the Village better than Quickbooks.

-The Village should also check with the township and determine the amount of water they are using specifically for the fire department.

-The Cross Connection bids are on hold. The Village will submit a request for more bids to the Michigan Municipal League. This is a free service.

-It was brought to the board’s attention that the Township has two cross connections that have never been inspected.

-The board will need to determine whether or not the Village will fine property owners or charge a fee.

-Planning Commission meeting to be held October 7, 2014 at the Village Hall.

-The board should consider hiring a Deputy Clerk/Treasurer.

Motion by Ron seconded by Jeff to approve the letter to the DEQ regarding deficiencies. It will be mailed out Friday August 22, 2014. Motion Carried.

Motion by Jackie seconded by Jeff to hire a professional to look at the hot water heater in the park and to fix or replace it as soon as possible. Motion carried.

Motion by Jeff seconded by Jackie to approve the updated lease edited by the village attorney and to turn it over to the  Museum Committee for their approval and signatures. Motion carried.

Motion by Ron seconded by Jackie to appoint Sally King as a member of the village of Bear Lake Planning Commission. Motion carried.

Motion by Jeff seconded by Ron to submit the Grant application for Cycle 2 of the Revenue Sharing. Motion carried.

Discussions Held On: 

-Report Fund reimbursements monthly. From Park, Water, Major St., and Minor St. to General. This to be included with the agenda.

-The hot water heater in the park is not providing adequate amounts of hot water for the campers to use. Contact a plumber to fix or replace it immediately.

-Well head protection plan needs to be updated by October 1, 2014. Use the original well head protection plan and update it with a 2 page letter. This procedure has been started.

-Alliance for Economic Success is having a meeting at the Methodist Church regarding blight. The Alliance is using Bear Lake as the model. Jeff, Jackie, and Ron are meeting with Chuck Erickson (County Building Inspector) in 3 weeks regarding all the buildings that fall under the blight category.

-In the future buildings in blight condition should be brought to the council’s attention by the community.

-It was recommended that the council consider using Joyce England as the Village Enforcer regarding blight. Richard Wilson an Attorney works with Joyce and the two have been very successful in getting buildings cleaned up. They are familiar with the courts in Manistee County.

-Meeting September 29, 2014 6-9 p.m. at the Manistee City Hall in regards to Streamlining Zoning Ordinances.

-Meeting August 28, 2014 at the Frankfort City Hall regarding the Recreation Plan for all communities.

-Rob Carson with the Manistee Planning Commission is trying to attend a meeting at all municipalities in the county. He is working on gathering information and getting all parks on a map.

-Chuck Erickson the Manistee County Building Inspector did confirm that the Village of Bear Lake does legally have possession of 7726 Lake St. Have the Attorney contact Mr. Erickson in regards to the letter and request a copy.

-There is nothing on paper that would stop a marijuana medical grow house from coming to the Village of Bear Lake. The Village should look into adopting Bear Lake Township’s ordinance.

-Regarding the Revenue Sharing Grants, anyone that had requested assistance for anything big did not get it. Most grants that were accepted had to do with first responder needs. The request we submitted regarding the new plow truck should really fall under the Public Safety requirements. Barb Farfsing’s husband is really good at writing grants and would be happy to assist the Village with that. When he writes the grants he does not need to bring them to the board for approval.

-Johnson’s can do a sewer study for the Village of Bear Lake free of charge. When it does come time for writing a grant there will be a $1,500.00 fee.

-FEMA- Jeff attended the FEMA meeting and stated that it cover the flood plains which we do not have. However, they are going to be putting together a correct topographical map of Manistee County.

-Dendra Best made requests to get copies of the 2014-2015 approved budgets. She provided a FOIA form at the meeting, which was not previously submitted. The budget will be sent to her within by the 25th of August.

Discussions Held On: 

-Scott Conradson, DEQ, John Bloemker DEQ, and Bob Schneider DEQ were guests of the Village of Bear Lake. They discussed the findings of the Water Reliability Study and it was determined by the DEQ that our rates are not sufficient to positively fund the Water Fund. Should a well fail, or a main water line need replacement the Village may not have the funds to repair them. It was recommended by the DEQ that the Village take another look at the rate methodology and implement some type of a rate increase over the next couple years. It was also determined that the Village should request bids to have an outside party perform the Cross Connection tests and paper work. The DEQ did note that Well #1 was going to need to be replaced first and we should make that our number 1 priority. Melanie Ware, Jeff Bair, and Jackie Johnson will work together to get the information the DEQ is requesting. The Village will respond to the DEQ on August 22nd, 2014.

-Richard Russell of the Bear Lake watershed announced their annual meeting would be held July 19, 2014 9:00 a.m.-11:00 a.m. Dick Graham will be the guest speaker and he will be discussing storm drains.

-Update on the SAW Grant: We did not receive any funds this round but there may be funds available next year.

-Annual Banquet for the Watershed is August 9, 2014 at 5:30 p.m. at the Fallen Timbers.

-Melanie to call Charter and have phones and internet hooked up in the Hall.

-Jeff to call Consumers regarding a second meter to separate the museum from the Village Hall.

-Glen will have Howard contact Thompson Tree Removal regarding the Leatherman tree on Cody St.

-Melanie to email the lease between the Village and the Museum to the Village Attorney for review.

-Public input for the Master Plan went well.

-Department of Treasury has been in communication with John Leckrone and it was discussed that he had to make a decision regarding the Variety building within 2 weeks.

Discussions Held On: 

-Manistee County Planning Department is getting a head start on future grants and will be checking the length and diameter of the man holes and would like to keep interest going for the Bear Lake Watershed.

-Pickle ball courts have been resurfaced. 

-There is some concern of a piece of metal sticking out of the rocks out on the peninsula and it should be removed to avoid injury.

-Speak to charter about putting up various stations in the park for internet and also let them know that we have a check ready to send but expect the service that we were quoted.

-Charlie Leatherman has a tree on Cody Street that is dying and should be looked at for removal.

-There is a possibility that the bathrooms in the Museum may not need to be ADA because the Museum is a historical building. The Museum Historical Society is looking into it. The drains and faucets are leaking and will need to be repaired. There are valves to shut the water off so that the leaking will stop until a plumber gets there to fix the leaks.

-The Reed children are using the shower at the park.

-The new sign has been ordered for the Museum.

-Jeff will look up a lease and email a copy to Melanie.

-The roof is still leaking in a spot and will be fixed.

-No one opposed the Master Plan. The resolution will be here in time for the next meeting.

-The council should start considering whether the deteriorating buildings on US 31 should be torn down or if they should be repaired.

-Ask the Village Attorney if we can change the misdemeanor to a civil infraction regarding the Blight Ordinance. 

-There are two openings on the planning commission.

-The grant was denied for a new snow plow truck.

-The Clerk and Treasurer will meet once a week to sign checks.

Motion by Jackie seconded Jeff for Melanie to contact the Village Attorney to write two letters, one letter to Jim Reed and the other to Leckrone’s regarding the buildings crumbling state and the junk and blight surrounding the buildings. Include a copy of the junk and blight ordinance and set dates that the building and properties should be cleaned by and enforce the fines stated within the ordinance. Include property tax ID numbers on all properties. 15 Calendar days from the receipt of the letters. Motion carried.

Discussions Held On:
-Residence at 7616 Cody Street called in the fall to have the water shutoff and it did not get turned off therefore there was some broken pipes that caused damage to the house. Melanie will contact insurance company and file a claim.
-The Bear Lake Museum was wondering about the liability insurance and if they need a rider.
-The Bear Lake Area Museum now has a Federal Tax ID number and funds can now be transferred from the Historical Society.
-The board has created a Museum Committee to approve needed repairs. Jackie Johnson, Jeff Bair, and Ron Ronning.
-The basement under the new Village building and Museum will be used for storage. The bathroom in the museum will need to be brought up to ADA codes.
-Planning Commission May 27th is ends the review period of the Master Plan. A public hearing date has been set for June 17, 2014 at 7:00 p.m.
-The Regional Prosperity Plan consisting of 10 Counties, the Blight is the biggest concern.
-Bear Lake Watershed meeting July 26, 2014 @9:00 a.m. at the Bear Lake Methodist Church.
-The Planning Commission is in need of a new member.
-Howard to turn the water on in the new Village Offices.

-Regarding the Leckrone building located at 7718 Lake St, chunks of brick are falling onto the sidewalk and someone could really get hurt.
-there were two leaking toilets in the women’s bathroom in the Park. They were replaced.
-Send letter to the Girl Scout Troop that cleaned up the park from Sparkle in the Park and thank them .
-WiFi to be installed in the park by May 1, 2014.
-Call George Saylor regarding who they use for their audit.
-New brush cards to be mailed out.
-Alarm for the generator keeps going off. Need to get someone up there to look at it.
-The next meeting regarding the grant will be June 9, 2014, they will be rewarding grants at that time.
-The Village should present to the Bear Lake Area Historical Society a functioning building for them to start with.
-The official copy of the Lakes to Land Regional Initiative Master Plan has arrived.

-Frozen main on Smith St., they are plastic (pvc pipes) and cannot be thawed. Pipes should be changed.
-Check with auditors to get the break down for the last audit. Are we obligated to stay with them? We never did get copies of the final audit. We will look into it further.
-Charter Internet should be hooked up May 1st, 2014.
-another deposit for the Museum Fund in the amount of $550.00
-gas bill for the museum building was over $400.00.

-Jeff Harthun will be the contact when Pauline has her surgery.
-The Museum needs a p.o. box.
-Museum should join Manistee County Arts & Culture Association, so that donors can have a tax deduction.

Discussions Held On:
-Pauline Jaquish shared the Village of Bear Lake Museum Committee Members, they are as follows: Chairman: Pauline Jaquish Secretary/Treasurer: Vicki Mackey Committee Members: Carver & Gloria Edwards, Jeff Harthun, Laura McBride, Bill Merriman, David Reed, Red Ronning, Carol Urbanus, and Linda Young.
-The Village received the BP grant and a bank account will be open.
-Some repairs noted that are needed for the Village Museum are a ramp for the entrance and a bathroom may need to be added, also some electrical needs attention and some ceiling tiles need to be replaced.
-Some volunteers have offered to paint and clean up the new Village Hall. We still need to wait for warmer weather to get water turned on.
-Pauline Jaquish to design a letter head to be used by the museum.
-2014 Budget Hearing will be held after our February 19, 2014 Regular meeting at approximately 8:30.
-If water is turned off the residence still gets a bill if they are outside the Village parameter. They also pay the shut off fee.
-There were some mistakes on the existing and future maps for the Master Plan. The errors are being corrected.
