January 16, 2008

The Regular Meeting of the Bear Lake Village Council was called to order by President Glen Moore at 7:30 p.m. at the Bear Lake Village Hall.

Council Present: Carver Edwards, Howard Higley, Alice Howe, Don Hyrns, Jim Mlejnek, Glen Moore, Larry Mortenson, Michelle Mortenson, Ron Ronning and George Schafer.

Absent: None.

Guests: None.

Minutes: The December 2007 minutes were approved as presented.

Motion by Carver seconded by Don to pay the bills as presented. Motion carried.

Motion by Ron seconded by Carver to sign the contract agreement between the Village of Bear Lake and Manistee County for tax maps, assessment roll maintenance, tax rolls, tax bill and computer services for 2008 at the rate of $1.06 per parcel. Motion carried.

Motion by Don seconded by Jim to allow the Bear Lake Promoters to utilize Hopkins Park for their annual Easter Egg Hunt to be held March 22, 2008. Motion carried.

Discussions Held On:

  • Jim will call the Sheriffs department to inquire about snowmobiling rules and/or enforcement of speeding in the Village limits.
  • Emergency start directions for the well along with pictures will be placed at the Village Hall in case of emergency.
  • A special meeting to discuss the budget will be held on February 13th, 2008 at 7:30 p.m. at the Village Hall
  • The Village Contingency Plan will be updated and put on file.
  • The next Lake Improvement Board meeting will be held on February 21, 2008
  • Carver Edwards gave an update on the Lake Improvement Board minutes.
  • George questioned the possibility of raising the quarterly water rate in an effort to generate money to various repairs in the Village.

BUDGET HEARING
February 13, 2008

The Budget Hearing was called to order by President Glen Moore at 7:30 p.m. at the Bear Lake Village Hall.

Present: Carver Edwards, Alice Howe, Don Hyrns, Jim Mlejnek, Glen Moore, Larry Mortenson, Michelle Mortenson and Ron Ronning.

Absent: George Schafer

Funds: The budget was presented with brief discussion on the various accounts. Changes were made to include the audit amounts for $500 in the Park Fund and $600 in the Water Fund.

February 20, 2008

The Regular Meeting of the Bear Lake Village Council was called to order by President Glen Moore at 7:30 p.m. at the Bear Lake Village Hall.

Budget: Motion by Carver seconded by Don to approve the proposed 2008-2009 budget with the addition of line item: Joint Planning Committee, $2,000 in the General Fund. Motion carried.

Minutes: The January minutes were approved as presented.

By Resolution a motion by Ron seconded by Don to sign the Grant-In-Aid agreement with the Michigan DNR and Wade-Trim for the upgrade to the dock area for $19,500. Motion carried.

Discussions Held On:

  • A certified letter will be sent to a local resident in violation of the Winter Parking Ordinance.
  • The council will look for a new pick-up truck for the Village.
  • The next Autum Glory Day will take place on the second Saturday in October of 2008. There will also be a Farmers’ Market every Friday beginning Memorial Day from 4 to 8 p.m. at the former gas station on Lake St (U.S. 31).
  • A reminder that the Lake Improvement Board will be holding a meeting on February 21 & 28 to discuss the special assessment district for the Milfoil project.
  • The Council plans to repair 3 fire hydrants in the spring/summer.
  • The Millage rate last year was set at 10.5501 and we expect it to be the same for 2008. The council will discuss and vote on the Millage rate at the regular March meeting.

Motion by Don seconded by Carver to put notices in the water bills reminding residents not to park or not to sprinkle a day or two before the roads are scheduled to be fixes. Should be in early June. Motion carried.

Motion by Don seconded by Carver to have the Manistee Road Commission add oil to the blacktopping during road repair this summer. Motion carried.

Motion by Ron seconded by Don to purchase a Village truck from Yates Chevrolet for the total of 10,894.00. Motion carried.

Motion by Don seconded by George to allow the park manager to purchase a new bulletin board for the campground. Motion carried.

Motion by Don seconded by George to pay Donna Ronning $45 for meetings she attends regarding Hopkins Park updates. Motion carried.

Motion by Geroge seconded by Ron to endorse the assessment roll for the Special Assessment District. Motion carried.

Discussions Held On:

  • Dates for the brush pick-up have been set as follows: April 10 (11) & 24 (25), May 15 (16), June 12 (13), July 10 (11), August 14 (15), September 11 (12), October 9 (10).
  • The Village will check into having the water tower repainted.
  • Howard will put cards regarding “no parking” on vehicles parked in the roadway a day or two before road repair.

Motion by Don seconded by Ron to sign the Charter Communications Uniform Video Service Local Franchise Agreement. Motion carried.

Motion by Don seconded by Carver to hire Josh Groenwald back as part-time summer help at the rate of $8.00 per hour. Motion carried.

Motion by Carver seconded by Jim to have McBride Septic Systems repair three hydrants in the Village. Motion carried.

Motion by Don seconded by Jim to sign the Proposal and Contract Agreement with Dixon Engineering to perform a maintenance inspection for the amount of $1,810.00. Motion carried.

Motion by Ron seconded by Jim to close the usual streets for Bear Lake Days and allow the tennis court to be used for the Dog Contest as requested by Nancy Richard. Motion carried.

Discussions Held On:

  • Gregg and Kim Brown presented a copy of the proposed upgrades for the property next to Richmond Drug. The Council approved of the design and looked forward to seeing the improvements made.
  • The lower interest rate was discussed and the clerk will check into other interest-bearing options.
  • A general reminder regarding that work performed on Village property must be approved by the Council before changes are made.
  • Two decals will be ordered from Northern Design and Sign for the new Village truck at a cost of approx. $100.
  • Wade-Trim will be contacted regarding the agreement for the boat launch upgrades.
  • Flowers will be purchased for Hopkins Park next month.
  • A new bulletin board was purchased for the park in the amount of $535.50.
  • Council members will check on removing dead limbs and trees in the Village.
  • The Village will put the old truck for sale.
  • Two people will be present when homeowner’s water must be turned off.

Motion by Carver seconded by Jim to refrain from selling water to business owners that do not reside in the Village or Township. Motion carried.

Motion by George seconded by Jim to honor rules set for park. Anyone who stays on a drop in site must pay the daily rate. Motion carried.

Discussions Held On:

  • Brian Sousa addressed concerns regarding the Professional Services Agreement between the Village of Bear Lake and Wade Trim. Further questions will be sent to the DNR for their response.
  • Various ideas to curb the use of the deck by skateboarders were discussed.
  • Barricades were put on the sidewalk along Lynn Street for pedestrians safety.
  • Minutes and Treatment Plans from the Lake Improvement Board of Bear Lake were distributed.
  • Road Commission changed the date of the road repair to the third week of June.
  • Customer water bill payments and the need to collect was discussed.
  • Old Village Truck was sold.
  • Resident complaint regarding yard cleanup was addressed with letters sent to homeowner and Manistee County Health Dept. The Council will continue to followup on this issue.
  • Followup will also continue on the need for repairs of a building located on Lake Street.
  • The need for a new Junk Ordinance was discussed. The council will address this issue at the next meeting.

– Some holes were patched on Village roads.

Guest Don Oswell gave an overview of a complaint filed against him in regards to closing the Burnham Street Access frequented by Village residents. He requested the councils official support in keeping it open for public use.

Motion by Carver seconded by Ron to prepare a letter of support in keeping the Burnham Street Public Water Access open. Motion carried.

Motion by Ron seconded by Don to purchase a $185.00 foot operated sanitary latch for the waste disposal unit in the park in order to comply with the state guidelines. Motion carried.

Motion by Don seconded by Larry to purchase a new chainsaw if replacement parts for the current chainsaw are unavailable. Motion carried.

Motion by George seconded by Ron to give the current clerk and treasurer a raise. Motion carried.
Discussions Held On:

– A 3-year customer service agreement between the Village and Allied Waste was discussed. Council will revisit the issue at the next meeting.
– Manistee County Sheriff’s Office sent a booklet explaining the Michigan Emergency Management Assistant Compact. The Council will review booklet.
– A report regarding complaints in the park were addressed. Signs will be printed in an effort to curtail dogs running free in the park and on the beach. Signs will also be made in an effort to give fisherman/women a place to park vehicles and trailers.
– The Manistee County Road Commission hopes to repair the roads within the next month or so.
– A complaint was received about residents water their lawns consistently on off hours. A letter will be sent to each homeowner.
– A water tank inspection will be held sometime late summer/early fall.
– The running board repair on the dump truck will be approximately $2,000.
– Inspections regarding a few buildings in the downtown area will be held before fall.
– Advertising on the Village website was discussed with the Council declining to offer this service to businesses at this time.
– Four council members, the president, clerk and treasurer positions will be on the November ballot.

– Allied Waste is being combined with a new waste company therefor the customer service agreement to be signed has been put on hold.

– The updated Manistee Sheriff’s Emergency Compact was discussed with no action taken.

– Waiting on additional information regarding the Boat Launch Grant.

– Street Administrator will check on actual road mileage in the Village limits.

Motion by  Carver seconded by Ron to transfer $5,000.00 from the Major Street Fund to the Minor Street Fund. Motion carried.

Motion by  Ron seconded by Larry to close the Building Fund CD and transfer $25,000.00 to the Minor Street Fund. The remaining money will be put into a new CD. Motion carried.

Motion by  Jim seconded by Carver to pay the Manistee County Road Commission $46,970.22 for street repair. Motion carried.

Motion by  Larry seconded by Jim to have Galaxy Electrice change the electrical faults to comply with MML recommendations. Motion carried.

Minutes:  The September minutes were approved as presented.

Discussions Held On:  – Rick Farfsing supplied the Village with a general accounting of money spent thus far on the Village Park and “Bear” land improvements. – Questions about the recent water tank inspection were addressed with the results being published in the Village minutes when available. – Various changes were made to the Village Hall in accordance with the recent recommendations from the Michigan Municipal League. – The clerk will contact the Lansing Building Code office to check on the status of a downtown building inspection. – Treat or treating hours are 5:00-8:00 pm on Oct. 31.

  • A followup regarding the repair of a downtown building will be performed.
  • A newsletter will be sent out with the next water bills. Information will include village water rules, campground updates and more.
  • A new sidewalk ordinance was discussed. More discussion will follow at the next regular meeting.
  • Designs for the upgraded dock area in Hopkins Park was presented. No action taken at this time. – The Health Dept. is following up with a complaint made by the Village Council.
  • The water leak of S. Shore Drive should be repaired within a week or two.

Discussions Held On:  – Mailboxes & posts that run along Village streets will be evaluated and residents will be sent letters if they need to be moved off the edge of the street. – A request for a sign was received by Bear Lake Marine. Size and placemat was discussed with followup questions to be asked of Michigan Logos. No other action taken at this time. – Received recommendations for upgrades and repairs concerning the water tower. Repairs will need to be made within 3-5 years. Water superintendent McBride will check on a few alternatives. – Boat Launch upgrade paperwork is progressing. Waiting for approval from Wade-Trim. – The new Sidewalk Ordinance was discussed with approval to be taken at next month’s meeting. – A cover letter along with numerous letters from community members and visitors will be sent to the Lansing Bureau of Construction Codes, Michelle McManus and Dan Scripps regarding the buildings along Lake street. – George gave an update on the Jt. Planning Committee’s Comprehensive Plan and the next steps that will be taken. The council will review the plan at next months meeting.
