The following FOIA Request has been filed on behalf of individuals who are physically unable to attend Village Council Meetings.

Good morning Cindi,

a number of our subscribers and Editorial Board have asked when we might receive the requested FOIA documents?
 
You have asked in the past not to be contacted by multiple people – hence this account is the primary contact email. Thank you for forwarding the Approved December 2016 Village Council Minutes.
 
A reminder – these are the 3 requested actions from January 17, 2017 under: Michigan Freedom of Information Act (FOIA), being Act 442 of the Public Acts of 1976, as amended.
 
1. Respectfully, we have requested copies of the itemized December 2016 Budget To Actual Fund reporting spreadsheets which list expenditures and balances in each Budget line item by Fund, as these would have been provided at the December meeting to enable the authorization of the payment of bills.

As public documents these are not subject to FOIA but if you require a FOIA Request this email constitutes that request – and as FOIA Coordinator this does not require an attorney review and authorization for you to forward the requested documents.
2. Six Month Subscription Request under FOIA
As a digital media news service, providing information to residents and tax payers we are again requesting, respectfully, in advance of each Special, Commission and Regular Council Meeting, by electronic means, the full packet of documents and Agenda provided for Council / Commission Members and made available to all who may physically attend such meetings.
 
Specifically we are requesting all documents referenced in, and including, each meeting Agenda for all meetings from January 2017 to June 30, 2017.
 
Again, as public documents these are not subject to FOIA but if you require a FOIA Request this email constitutes that request – and as FOIA Coordinator this does not require an attorney review and authorization for you to forward the requested documents.
 
As these are documents prepared for Council Trustees this does not incur any additional time or expense for the Village of Bear Lake. Please forward to this email address.
 
3. In addition, this request is submitted under Title VI (Referenced in the Village Title VI Non Discrimination Plan with yourself as the Village Title VI Coordinator) 
The Village of Bear Lake serves all people, including minority populations, low income populations, the elderly, persons with disabilities, and those who traverse the Village.  The Village of Bear Lake, recognizes in responsibility to provide fairness and equity in all of its programs, services, and activities, and that it must abide by and enforce federal and state civil rights legislation. 
The Village of Bear Lake has developed this Title VI Plan to assure that services, programs, and activities of the Village of Bear Lake are offered, conducted, and administered fairly, without regard to race, color, national origin, sex, age, or disability of the participants or beneficiaries of federally funded programs, services, or activities (see Title VI Assurances).

    • (1) A public entity shall take appropriate steps to ensure that communications with applicants, participants, members of the public, and companions with disabilities are as effective as communications with others.”
We are requesting the reinstatement of audio recordings of all meetings, to be made available for registered voters and property owners who are unable to physically attend live on site meetings. Again, we are offering to purchase and provide digital recording devices to enable instant archiving and file sharing.
